Hiniling ni dating Chief Justice Renato Corona sa Sandiganbayan Third Division na ibasura ang mga kasong inihain laban sa kanya sa diumano’y misdeclaration ng kanyang Statement of Assets, Liabilities and Networth (SALN) mula 2003 hanggang 2010.
Naghain si Corona ng motion to quash sa graft court na humihiling na ibasura ang walong bilang ng perjury sa ilalim ng Article 183 ng Revised Penal Code (RPC) at walong bilang ng paglabag sa Section 8 in relation to Section 11(a) ng Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
“From the foregoing, accused respectfully submits that the assailed information should be quashed on the ground that the facts alleged therein do not constitute a criminal offense both for the crime of perjury and for violation of Section 8, in relation to Section 11, of R.A. No 6713,” saad sa mosyon na isinampa ng kanyang mga abogado.
Binigyang diin ng mga abogado ng depensa na ang prosecutors “failed to state the ultimate facts which would show that accused willfully and deliberately asserted a falsehood” na isa sa mga elemento ng perjury sa ilalim ng RPC.
